BT & Talk Talk have won a judicial review re. the Digital Economy Act which allows for sanctions against copyright infringement. Under the Act, after three warnings the possibility exists that Internet connections will be restricted or even disconnected. The idea is full of kinds of problem issues such as the accuracy of IP addresses being able to prove usage.
I think I’m right in saying that a judicial review is where a bunch of judges are asked to rule on the legality of legislation. It might, for example, contravene European law.
Also, I signed a petition (along with around 35,000 others) a few months back asking that the new law be abolished. It was set up by Andrew Heaney of Talk Talk. Yesterday the government (different govt now) responded. They basically supported the legislation but said that measures in the act do NOT allow for disconnection. Really?
I thought this legislation wouldn’t fly and was surprised it got through Parliament. I hope it falls to ground again.
